I. General terms
1. This document contains General Terms and Conditions, according to which the trader provides services to its customers through the online store scorpion-helmets.com. These conditions are binding on all users. By clicking the “Continue” button, the customer agrees, fully accepts and undertakes to comply with these Terms and Conditions.
2. Identification of the client in order to reproduce his statement for acceptance of the General Terms, and for the order, is made through storage of the log files on the server of scorpion-helmets.com, storage of the client’s IP address and any other information.
3. The products available on the website of scorpion-helmets.com do not constitute a legally binding offer, but are rather a demonstrative online catalog describing the product line of the seller.
4. After clicking the “Buy” button, the users agree to purchase the items in the “Basket”. This action is legally binding. The customer receives a confirmation of the order and upon receipt of this confirmation it is considered that the contract has been concluded.
5. The trader reserves the right to refuse delivery of a confirmed order in case the goods are not available. If the ordered goods are out of stock, the seller notifies the customer by sending a message to the e-mail address specified by the customer or to the specified phone number as soon as possible. In case a bank transfer has been made to the seller’s account, the customer will be able to choose between a refund, a cancellation of the order or a replacement order.
6. All prices are with VAT.
II. Payments
1. You may pay your order with a bank transfer to our company bank account or by virtual POS, with your debit/credit card.
2. Bank account payments should be made only after our confirmation for exact delivery cost and after final verification of item availability. We will e-mail you exact payment amount and confirmation.
3. Payments made trough virtual POS will be authorized, and if any refund will be necessary – we will authorize the refund amount back not later then 1 business day after refund was agreed.
III. Delivery
1. Immediately after delivery, the goods should be carefully inspected by the customer. Any damage should be reported immediately to the seller. If the indicated address, contact person and/or phone number is wrong, the seller is not bound by any obligation to fulfill the order.
2. When the delivered goods clearly do not correspond to the ordered by the customer, and this can be established by its ordinary inspection, the customer may request the delivered goods to be replaced with those corresponding to his purchase order within 24 hours of receipt. In that case the transport costs are for seller’s expenses.
3. In case of refusal to receive the goods, except in the cases described above, the refusal is considered unfounded. The transport costs in this case are AT THE EXPENSE OF THE CLIENT according to the tariffs of the courier company. (In case of replacement of goods the customer must pay 2 courier fees for transport in both directions). The goods must not be used, but must be in the original packaging and together with all their accessories. In case the client is not found within the deadline for delivery on the specified address, the seller is released from his obligation to deliver the goods.
IV. Warranty
1. The warranty of the outside shell is 5 years, the warranty of the mechanical parts is 1 year.
V. Rights and obligations of the customers
1. The customer is fully responsible for the protection of his username and password, as well as for all actions performed by him or by a third party using his username and password. The client is obliged to immediately notify the seller of any case of unauthorized access by using his username and password, as well as whenever there is a danger of such use.
2. The client is obliged to pay the price of his order.
3. The customer is obliged to indicate an accurate and valid telephone number, delivery address and e-mail address, to pay the price of the goods, to pay the delivery costs when it is not free and to provide access and opportunity to receive the goods.
3.1. Every user, regardless of whether he is a customer of the online store, when using its services is obligated to:
• not to violate and to respect the fundamental rights and freedoms of citizens and human rights;
• to immediately notify the seller of any case of committed or discovered violation when using the provided services;
• to indemnify the trader and all third parties for all damages and lost profits, including any costs and paid attorney’s fees incurred as a result of claims and/or compensations paid to third parties in connection with websites, hyperlinks, materials or information that the User has used, posted on the server, sent, distributed, made available to third parties or made available through scorpion-helmets.com in violation of the law, the General Terms, Good Morals or Internet ethics.
VI. Rights and obligations of the seller
1. The seller does not have the obligation and the objective ability to control the way in which the customer uses the provided services.
2. The seller has the right at any time, without notifying the customer, to suspend or change the services provided in connection with the use of the site, if the customer uses the services in violation of these terms. The seller is not liable to consumers and third parties for damages and lost profits resulting from the termination, suspension, modification or restriction of services, deletion, modification, loss, inaccuracy, or incompleteness of messages, materials or information transmitted, used, recorded or made available through scorpion-helmets.com.
3. After receiving the payment, the seller is obligated to transfer to the customer the ownership of the ordered goods, to deliver the goods on time and to check for technical condition each item before sending (if possible, without to break the integrity of the packaging).
4. The seller is not liable for any damage caused to the software, hardware or telecommunications equipment, or for the loss of data resulting from materials or resources sought, downloaded or used in any way through the services provided. Advice or assistance provided by the seller’s specialists and employees in connection with the use of the services by consumers does not give rise to any liability or obligation for the seller. The company is not responsible for incorrect information provided by the manufacturer about the product.
5. The seller has the right to collect and use information relating to its customers, whether or not they are registered. During account registration, the customer undertakes to familiarize himself with the “Terms and Conditions of Use” provided by the seller. After ticking, it is considered that the user has read and agrees with the declaration. In case the user declares that he does not agree, the seller has the right to immediately suspend or terminate the provision of services to the user.
6. The information under the previous article may be used by the seller, except in case of explicit disagreement of the user, sent to an e-mail address or from the contact form. The trader collects and uses the information only to perform the service of selling the goods to the customer and to improve the services offered. All purposes for which the trader will use the information will be in accordance with applicable international instruments and good manners.
7. The seller shall not be liable for non-performance of its obligations under this Agreement in the event of circumstances which the seller did not foresee and was not obliged to foresee – including cases of accidental events, problems in the global Internet and in the provision of services beyond the control of the seller.
VII. Personal data
1. The seller guarantees to his users the confidentiality of the provided information and personal data. The latter will not be used, provided or brought to the notice of third parties, except in the cases and under the conditions specified in these “Personal Data”. The seller protects the personal data of the customer, which became known to him when filling in the electronic form for making a purchase application, and this obligation is waived in case the customer has provided incorrect data. Subject to applicable law and the provisions of these Terms and Conditions of Use, the seller may use the customer’s personal data only for the purposes provided in the contract.
VIII. Changes
1. The General Terms and Conditions may be changed at any time by the seller, who has the right to change the characteristics of the provided services and these Terms and Conditions and on the basis of changes in the legislation. The seller undertakes to notify the user of the changes in the Terms and Conditions by publishing a notice of their changes in a prominent place on its website or by newsletter and giving them sufficient time to become acquainted with them. Within the given period, if the customer does not declare that he rejects the changes, he is considered bound by them. In case the consumer declares within the given term that he does not agree with the changes, the seller has the right to immediately suspend or terminate the provision of services to the customer.
VIII. Terminology
1. By “client/customer” is meant anyone who has registered in the online store scorpion-helmets.com.
2. “Order” means the selected goods and all other attributes related to the method of delivery and payment of the goods by the client/customer.
3. The online store scorpion-helmets.com is owned by the seller.
4. All disputes between the parties shall be settled in a spirit of understanding and good will. In the event that no agreement is reached, all unresolved disputes, including disputes arising out of or relating to its interpretation, invalidity, performance or termination, as well as disputes concerning the filling of gaps in the contract or its adaptation to new circumstances, shall be resolved by the competent court for registration of the trader.[/vc_column_text][/vc_column][/vc_row]
